The European Union’s General Data Protection Regulation (GDPR) comes into force on 25th May 2018. GDPR brings many organisations and businesses in India within the reach of EU data regulators, with significantly increased financial penalties, reaching up to 4% of an organisation’s global annual turnover or €20 million (whichever is the higher). European Regulators have an extensive toolkit of sanctions, including the ability to issue business-ending “stop now” orders to prevent or suspend the processing of personal data in breach of GDPR. GDPR applies to any organisation, wherever incorporated or established, operating within Europe, or marketing goods or services to European data subjects. It restricts the transfer of personal data outside Europe, and includes provisions that can compel organisations to make a hard choice between breaching GDPR or breaching the laws of other jurisdictions.
